Notice Regarding Heat Supply to All City Residents Who Are Residential Leasehold Tenants
The Code of the City of Asbury Park, Chapter XIII, Section 6022, states that if a lease requires the landlord to provide heat, the landlord must give you the amount of heat required by the state codes and the local town or city ordinance.
Under the state housing codes, from October 1 to May 1, the landlord must provide enough heat so that the temperature in the apartment is at least 68 degrees from 6 a.m. to 11 p.m.
Between the hours of 11 p.m. and 6 a.m, the temperature in the apartment must be at least 65 degrees. N.J.A.C. 5:10-14 et seq. and N.J.A.C. 5:28-1.12(m). This requirement only pertains to leasehold occupancies where the Lease Agreement specifically includes a requirement that your Landlord is responsible to provide heat in your dwelling unit.
Failure to Comply
In the event that your Lease Agreement has such a provision, and the Landlord fails to comply with the requirements of Section 602.2 of the City Code referenced above, please contact the Department of Property Improvement and Neighborhood Preservation immediately at 732-502-5742 or email Tamica Smith.
